Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Fernsehturm ("FST", "Fernsehturm", "we", "us", or "our"), including the Fernsehturm website, documentation, local runtime, command-line tools, SDKs, connectors, activation services, hosted services, support channels, and related software or services.
By using FST, you agree to these Terms. If you use FST for an organization, you represent that you have authority to bind that organization. If you do not agree, do not use FST.
Separate written agreements, enterprise terms, data processing agreements, support terms, marketplace terms, open-source licenses, or order forms may also apply. If a signed agreement conflicts with these Terms, the signed agreement controls for the covered use.
What FST Does
FST is a process-control runtime for agent work. It helps define and enforce controlled runs, scoped actions, gates, approvals, evidence, artifacts, audit records, replay, and protected-effect checks.
FST is not a substitute for your judgment, security program, legal review, compliance program, change-management process, or business controls. You remain responsible for deciding which agents, users, process packages, connectors, stores, credentials, approvals, and deployment configurations are appropriate for your use.
Accounts And Authority
You are responsible for all activity under your accounts, local installations, activation bindings, credentials, connectors, agents, approval providers, and deployment environments.
FST separates capability from authority. An agent may request or prepare an action, but approval must come through the configured trusted path. You are responsible for configuring and protecting that path, including local authority passwords, account bindings, identity providers, approval providers, role assignments, credential stores, and connector scopes.
You must provide accurate account, billing, and contact information and keep it up to date.
License And Use Rights
Subject to these Terms and any applicable license, subscription, or order form, we grant you a limited, non-exclusive, non-transferable right to use FST for your internal personal or business purposes.
Some FST components, examples, packages, SDKs, or dependencies may be provided under open-source licenses. Those licenses apply to the covered materials. These Terms do not limit rights you have under applicable open-source licenses.
You may not copy, modify, distribute, host, resell, sublicense, or provide FST as a service except as permitted by the applicable license, subscription, contract, or written permission from us.
Acceptable Use
You may not use FST to:
- violate laws, regulations, contracts, third-party rights, or privacy rights
- gain unauthorized access to systems, data, accounts, networks, or credentials
- bypass, disable, misrepresent, or interfere with approvals, gates, audit records, entitlement checks, usage controls, security controls, or authority boundaries
- submit malicious code, exploit payloads, abusive traffic, or harmful content to our services or third-party services
- overload, scan, disrupt, or reverse engineer hosted services except where lawfully permitted
- use FST to make decisions or take actions in high-risk domains without appropriate human oversight, validation, and legally required controls
- remove notices, hide provenance, or falsely suggest that work was approved, reviewed, or authorized
Your Data And Content
You retain ownership of your content, including process profiles, artifacts, evidence, approval records, audit exports, connector data, configuration, and other data you provide or generate through FST.
You grant us the rights needed to provide, secure, support, and improve FST, including processing content you submit to hosted services, activation services, support channels, or connected integrations. For local-only use, your local runtime data generally remains on systems you control unless you choose to send it to us or a third-party service.
You are responsible for ensuring that you have the rights and permissions needed to process, store, transmit, approve, export, or delete data through FST.
Credentials, Connectors, And External Systems
FST can call or coordinate with external systems through connectors, APIs, workflow tools, chat gateways, email providers, ticket systems, source control systems, databases, cloud services, and other integrations.
You are responsible for the credentials, scopes, permissions, configuration, policies, data flows, and third-party terms that apply to those systems. We are not responsible for third-party services, their availability, their security, or their handling of data.
Protected effects can still have real-world consequences. You are responsible for testing process packages, validating gates, limiting connector authority, reviewing approvals, and monitoring outcomes before using FST in production or with sensitive systems.
Plans, Payments, And Changes
Some features may be free, paid, usage-limited, preview, beta, self-hosted, hosted, team, or enterprise-only. Prices, packaging, feature availability, limits, and support commitments may change over time unless a written agreement says otherwise.
Paid subscriptions, renewals, taxes, refunds, trials, and cancellations are governed by the applicable order form, checkout flow, payment provider terms, or written agreement. You authorize us and our payment providers to process payments and related billing information for paid services you purchase.
Beta And Preview Features
FST may include experimental, beta, preview, or coming-soon features. These features may be incomplete, unavailable, changed, limited, or removed at any time. Do not rely on beta or preview features for production, regulated, or high-risk use unless a written agreement expressly permits it.
Security And Responsible Disclosure
You must not attempt to compromise FST, hosted services, other users, or third-party systems. If you believe you found a security issue, contact us at mail@fernsehturm.dev and avoid accessing, modifying, deleting, or disclosing data that is not yours.
Availability And Support
We may update, suspend, limit, or discontinue parts of FST. Hosted services may be unavailable because of maintenance, incidents, third-party failures, security concerns, or events outside our control.
Support obligations apply only where stated in a paid plan, enterprise agreement, support policy, or written commitment.
Disclaimers
FST is provided "as is" and "as available" to the fullest extent permitted by law. We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation.
FST may block, allow, delay, narrow, or request approval for actions based on the process packages, data, connectors, stores, approvals, and policies you configure. We do not guarantee that a configuration will prevent every unauthorized, unsafe, noncompliant, or undesired action.
Limitation Of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, use, or business opportunities.
To the fullest extent permitted by law, our total liability for all claims relating to FST or these Terms will not exceed the greater of the amount you paid us for FST in the twelve months before the claim or 100 US dollars.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnity
You will defend, indemnify, and hold us harmless from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your use of FST, your content, your connected systems, your breach of these Terms, or your violation of law or third-party rights.
Termination
You may stop using FST at any time. We may suspend or terminate access to FST if you breach these Terms, create risk, fail to pay amounts due, misuse the services, or if required by law.
After termination, local copies, local data, logs, credentials, packages, or exports may remain on systems you control. You are responsible for managing that local data.
Changes To These Terms
We may update these Terms from time to time. If we make material changes, we will update the date above and provide additional notice where required. Your continued use of FST after changes become effective means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the State of California, excluding its conflict-of-law rules, unless a written agreement says otherwise. Courts located in California will have exclusive jurisdiction for disputes arising out of these Terms, unless applicable law requires another forum.
